JMAR S.r.l. is also referred to in these terms as “JMARSHOP” or the “Seller”.

Scope of application
These terms govern access to the website and the online sale of products available on JMARSHOP.
Before placing an order, the Customer must read these terms carefully. By submitting an order, the Customer accepts the version published and available at the time of purchase.
A “Consumer” is a natural person purchasing for purposes unrelated to their business, trade, craft or professional activity.
A “Business Customer” is a person or organisation purchasing in connection with its business, trade, craft or professional activity.
Provisions specifically intended for Consumers, including the right of withdrawal and the legal conformity guarantee, do not apply to purchases made by Business Customers unless mandatory law provides otherwise.

Products and product information
The main characteristics, dimensions, materials, colours, quantities and prices of products are shown on the relevant product pages.
Photographs and graphic representations are for illustrative purposes. Displayed colours may vary slightly depending on the screen, lighting and characteristics of the material.
Plexiglass products may show minor variations compatible with the material and manufacturing process, provided that these do not affect their functionality or conformity with the declared characteristics.
Customers must carefully check dimensions, orientation, quantities and features before completing an order, particularly when purchasing personalised products or products made to individual specifications.
JMARSHOP may change its range, descriptions and product availability at any time. Such changes do not affect orders already accepted.

Ordering process and conclusion of the contract
Customers may select products, choose available options and add them to the basket in the required quantities.
Before final confirmation, Customers can review and correct:
• products and quantities;
• prices and taxes;
• promotional codes;
• billing and delivery addresses;
• shipping method;
• delivery costs;
• payment method;
• total order amount.
The order is submitted by pressing the final button clearly indicating that the purchase entails an obligation to pay.
After submission, the Customer will normally receive an automatic acknowledgement of receipt. This confirms that the order has been received but does not necessarily constitute final acceptance.
The sales contract is concluded when JMARSHOP sends an acceptance confirmation or a shipping confirmation, whichever is sent first.
Any payment authorisation or charge made before final acceptance does not oblige JMARSHOP to accept the order. If an order is not accepted, any amount already collected will be refunded.

Availability and non-acceptance of orders
All orders are subject to product availability.
JMARSHOP may refuse or cancel all or part of an order in the event of:
• product unavailability;
• an obvious price or description error;
• incomplete or incorrect information;
• payment not being authorised or received;
• suspected fraud or unlawful use of payment methods;
• inability to deliver to the stated address;
• unusual quantities inconsistent with ordinary online sales;
• breach of these terms.
The Customer will be informed promptly. Amounts already paid for unavailable products or rejected orders will be refunded using the original payment method where possible.

Prices, taxes and promotions
Prices are stated in euros and include VAT where applicable, unless clearly indicated otherwise.
Shipping charges and any additional costs are shown before the order is confirmed, after the delivery address has been entered.
The applicable price is the price displayed when the order is submitted and shown in the order summary.
In the event of an obvious pricing error, JMARSHOP will inform the Customer before dispatch and allow the Customer either to confirm the purchase at the correct price or cancel it for a full refund.
Promotions, discounts, promotional codes and free-shipping thresholds apply only for the period and under the conditions stated on the website. Unless otherwise indicated, offers cannot be combined.

Payments and invoicing
The payment methods actually available are those displayed during checkout.
Electronic payments are processed by protected systems and authorised providers. JMARSHOP does not directly store complete payment-card details.
The Customer must ensure that the information provided is correct and that they are lawfully entitled to use the selected payment method.
If payment is not authorised or completed, the order may be suspended or cancelled.
Where an invoice is requested or required under applicable law, the Customer must provide complete and accurate tax and billing information before completing the order. Invoices are issued in accordance with applicable tax legislation.

Shipping and delivery
Available destinations, territorial restrictions, carriers, costs and estimated delivery times are shown during checkout or on the shipping information page.
Orders are generally prepared within 5 working days after receipt of payment, unless a different preparation time is stated on the product page, during checkout or in the order confirmation.
Personalised, made-to-measure or temporarily unavailable products may require longer preparation times.
Any stated delivery date is an estimate and may vary for reasons outside JMARSHOP’s direct control.
Unless a different period has been agreed, delivery to a Consumer will take place within the period required by applicable law and, as a general rule, no later than 30 days after conclusion of the contract.
If delivery does not take place within the agreed period, the Consumer may ask JMARSHOP to complete delivery within an additional reasonable period. If delivery still does not take place, the Consumer may terminate the contract, except where the law does not require an additional deadline.
The risk of loss or damage passes to the Consumer when the Consumer, or a third party designated by them other than the carrier, takes physical possession of the goods.
Separate orders may be shipped separately and may incur separate shipping charges.

Inspection upon delivery and damaged goods
Upon delivery, the Customer should check:
• the condition of the packaging;
• whether there are visible openings, crushing or damage;
• the number of parcels;
• whether any products appear damaged.
Where visible damage is present, the Customer should accept the parcel subject to a specific and detailed written reservation on the delivery record.
Failure to make a reservation does not automatically remove the Consumer’s rights under the legal guarantee, although it may make it more difficult to prove that damage occurred during transport.
The Customer should report the problem to JMARSHOP as soon as possible and, where possible, provide photographs of the packaging, shipping label and product.

Consumer’s right of withdrawal
Consumers have the right to withdraw from the purchase without giving any reason within 15 days from the date on which they receive the product.
Where an order contains several products delivered separately, the period starts when the last product is received.
To exercise the right of withdrawal, the Consumer must communicate the decision before the deadline by making a clear statement through the “Contact us” page or by writing to:

Returns and refunds following withdrawal
After communicating the withdrawal, the Consumer must return the products without undue delay and no later than 15 days afterwards.
Unless otherwise stated, the direct cost of returning the products is borne by the Consumer.
Products must be carefully packaged and returned complete with any accessories. Use of the original packaging is recommended where available, but its absence does not automatically invalidate the right of withdrawal.
The Consumer is liable only for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
JMARSHOP will refund payments received for the returned products, including the original standard delivery charge, within 15 days after receiving the withdrawal notice.
Any additional cost resulting from the Customer choosing a more expensive delivery method than the standard method offered will not be refunded.
JMARSHOP may withhold the refund until the products have been received or until the Consumer provides evidence that they have been sent back, whichever occurs first.
Refunds will be made using the same payment method used for the purchase unless otherwise agreed.

Exceptions to the right of withdrawal
The right of withdrawal does not apply in the cases provided for by law and, in particular, to goods:
• made to the Customer’s individual specifications;
• clearly personalised;
• cut, engraved, printed or specifically modified at the Customer’s request where they cannot normally be resold without substantial alteration;
• falling within another statutory exception.
The exception does not automatically apply to a standard product merely because it is manufactured or prepared after the order is received.
The right of withdrawal does not apply to purchases made by Business Customers.

Legal conformity guarantee
Products sold to Consumers are covered by the legal conformity guarantee provided by Italian consumer law.
For new goods, the legal guarantee lasts 2 years from delivery and covers defects of conformity existing at the time of delivery that become apparent during that period.
In the event of a conformity defect, the Consumer is entitled to the remedies provided by law, which may include, depending on the circumstances:
• repair;
• replacement;
• a proportionate price reduction;
• termination of the contract and refund.
The guarantee does not cover problems caused by misuse, impacts, scratches occurring after delivery, improper maintenance, normal wear and tear, alterations made by the Customer or failure to follow instructions.
To request assistance, the Consumer should contact JMARSHOP, describe the problem and, where possible, provide photographs and the order number.
For purchases by Business Customers, the provisions of the Italian Civil Code concerning defects in goods apply unless otherwise agreed in writing.

Liability and force majeure
JMARSHOP makes reasonable efforts to keep the website information accurate and up to date but cannot completely exclude occasional technical or material errors.
Errors will be corrected once identified.
JMARSHOP is not liable for temporary website interruptions, network problems, unavailability of third-party services or events that cannot reasonably be controlled.
Nothing in these terms limits or excludes the Seller’s liability where such limitation or exclusion is prohibited by law, including cases of fraud, gross negligence or personal injury.
In the event of force majeure, including natural disasters, fire, flood, war, general strikes, epidemics, government measures or extraordinary disruption of transport or energy supplies, affected obligations may be suspended for the duration of the event.
JMARSHOP will inform the Customer and seek a reasonable solution. Mandatory Consumer rights remain unaffected, including the right to a refund where the contract cannot be performed.

Intellectual property
Texts, photographs, images, trademarks, logos, graphics, designs, videos and other website content are protected by intellectual and industrial property laws.
They may not be copied, reproduced, distributed, modified or used for commercial purposes without the prior written permission of JMAR S.r.l. or the relevant owner.

Privacy and personal data
Personal data is processed in accordance with applicable law and the website’s “Cookies and Privacy” page.
Data required to process the order may be communicated to parties involved in payments, shipping, customer support and tax obligations.

Complaints and dispute resolution
For complaints concerning products, payments, deliveries or services, Customers may contact JMARSHOP through the “Contact us” page or call +39 041 2688833.
JMARSHOP will seek to respond and provide a solution within a reasonable period.
Where applicable, Consumers may also contact an alternative dispute resolution body recognised under Italian and European law.
Lists of authorised bodies are available on the official websites of the Italian Ministry of Enterprises and Made in Italy and the European Commission.

Applicable law and jurisdiction
These terms and contracts concluded through JMARSHOP are governed by Italian law.
Consumers remain entitled to any more favourable mandatory protection provided by the law of the European Union country in which they habitually reside.
Disputes involving a Consumer are subject to the jurisdiction of the courts of the Consumer’s place of residence or domicile where required by law.
For disputes involving Business Customers, the courts of Venice, Italy, have exclusive jurisdiction unless otherwise agreed in writing.

Amendments and final provisions
JMARSHOP may update these terms. Orders remain governed by the version accepted at the time of purchase.
If one provision is found to be invalid, the remaining provisions remain effective.
In the event of discrepancies between translations, the Italian version prevails to the extent permitted by law, without affecting mandatory Consumer rights.
